Users are responsible for maintaining the confidentiality of their usernames, passwords, authentication methods, and all credentials associated with their accounts.

Users are responsible for all activities conducted through their accounts unless unauthorized use results directly from FOX's negligence or failure to maintain appropriate security measures.

If you suspect unauthorized access to your account, you should notify FOX immediately through our designated support channels.

5. Description of Services

FOX provides digital solutions designed to support asset management, wealth management, and Family Office operations.

Depending on the services selected, FOX may provide features including:

• Asset Management

• Document Management

• Cash Flow Management

• Dashboards and Reporting

• Financial Planning

• Estate Planning

• Calendar and Workflow Management

• AI Assistance

• Analytics and Decision Support

• Additional services introduced from time to time

FOX continuously improves its Services and may modify, enhance, suspend, or discontinue certain features where reasonably necessary. Where legally required or where changes materially affect users, appropriate notice will be provided.

6. Acceptable Use

Users agree to use FOX Services lawfully, responsibly, and in a manner that does not interfere with the operation, security, or availability of the Services or the rights of other users.

Users shall not use the Services for any unlawful, fraudulent, harmful, or abusive purpose, nor engage in any activity that may compromise the integrity, confidentiality, or availability of the FOX platform.

In particular, users agree not to:

• Upload, distribute, or transmit malware, viruses, ransomware, or other malicious code.

• Upload content that is unlawful, defamatory, fraudulent, misleading, or otherwise prohibited by applicable law.

• Use FOX Services to facilitate money laundering, terrorism financing, fraud, cybercrime, or other illegal activities.

FOX reserves the right to investigate suspected violations of these Terms and may take appropriate action, including restricting, suspending, or terminating access to the Services where necessary.

7. User Content

Users retain ownership of all information, documents, asset records, and other content that they upload or create within FOX.

Users are solely responsible for ensuring that such content is accurate, lawful, complete, and that they possess all necessary rights, permissions, or legal authority to submit the content to FOX.

Where users upload personal data relating to other individuals, users represent that they have obtained any required consent or have another lawful basis for providing such information to FOX.

FOX does not verify the accuracy, authenticity, ownership, or legality of user-generated content except where required by applicable law.

8. Intellectual Property

All software, source code, designs, user interfaces, databases, trademarks, logos, trade names, documentation, graphics, and other materials comprising the FOX Services are owned by or licensed to FOX and are protected by applicable intellectual property laws.

Except as expressly permitted under these Terms, no part of the Services may be copied, modified, reproduced, distributed, reverse engineered, decompiled, leased, licensed, sold, or otherwise exploited without FOX's prior written permission.

Nothing contained in these Terms grants users any ownership rights in the intellectual property of FOX.

9. Artificial Intelligence Services

FOX may provide Artificial Intelligence ("AI") features designed to assist users in generating reports, summarizing information, organizing documents, answering questions, or supporting wealth management activities.

AI-generated outputs are provided solely for informational and productivity purposes. They are not intended to constitute legal, tax, accounting, investment, financial, medical, or other professional advice.

Users remain solely responsible for reviewing, validating, and independently evaluating any AI-generated content before relying upon it for decision-making.

FOX makes no representation or warranty that AI-generated outputs will always be accurate, complete, current, or suitable for any particular purpose.

10. Third-Party Services

FOX Services may integrate with or provide access to third-party products, software, APIs, payment providers, identity verification providers, cloud services, artificial intelligence providers, or other external services.

Such third-party services operate independently from FOX and may be governed by their own terms of service and privacy policies.

FOX is not responsible for the availability, accuracy, security, performance, or practices of third-party services except where liability cannot be excluded under applicable law.

Users are encouraged to review the applicable terms and privacy policies of any third-party services they choose to use.

11. Fees and Payment

12. Suspension and Termination

FOX may suspend or terminate a user's access where, for example:

• FOX is required to do so by applicable law, a court order, or a lawful request from a competent authority.

• The user fails to pay applicable fees in accordance with the agreed payment terms.

Where reasonably practicable, FOX will provide prior notice before suspending or terminating access. However, immediate action may be taken where necessary to protect the Services, comply with legal obligations, or prevent significant harm.

Users may terminate their account at any time by following the account deletion process provided by FOX. Termination of an account does not affect any rights, obligations, liabilities, or legal claims that arose before the effective date of termination.

13. Disclaimer of Warranties and Limitation of Liability

FOX strives to provide reliable, secure, and continuously available Services. However, except as expressly stated in these Terms or required by applicable law, the Services are provided on an "AS IS" and "AS AVAILABLE" basis.

FOX does not warrant or guarantee that:

• the Services will always operate without interruption or error;

• the Services will always meet every user's expectations or business requirements;

• information supplied by users is accurate or complete;

• reports, calculations, analytics, or AI-generated outputs will always be accurate, complete, or suitable for any specific purpose; or

• the Services will be free from events beyond FOX's reasonable control.

To the fullest extent permitted by applicable law, FOX shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, business opportunities, goodwill, data, or anticipated savings arising from or relating to the use of, or inability to use, the Services.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

14. Indemnification

Users agree to indemnify, defend, and hold harmless FOX, its affiliates, directors, officers, employees, contractors, and representatives from and against any claims, damages, losses, liabilities, penalties, costs, or expenses (including reasonable legal fees) arising out of or relating to:

• violation of these Terms;

• violation of applicable laws or regulations;

• infringement of the rights of any third party;

• submission of information without appropriate legal authority; or

• misuse of the Services.

This indemnification obligation shall apply only to the extent permitted by applicable law.

15. Force Majeure

FOX shall not be liable for any delay, interruption, or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control.

Such circumstances may include natural disasters, war, terrorism, civil unrest, pandemics, labor disputes, widespread internet outages, cyberattacks affecting critical infrastructure, governmental actions, changes in law, failures of public utilities, or other comparable events.

FOX will make commercially reasonable efforts to restore affected Services as soon as reasonably practicable following the end of the force majeure event.

16. Changes to these Terms

FOX may revise these Terms from time to time to reflect changes in applicable laws, technologies, business operations, security practices, or the Services offered.

Where changes materially affect users' rights or obligations, FOX will provide appropriate notice through the Website, Mobile Applications, email, or other reasonable communication channels before or when the revised Terms become effective, where required by applicable law.

Continued use of the Services after the effective date of the revised Terms constitutes acceptance of the updated Terms.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, unless otherwise required by mandatory applicable law.

In the event of any dispute arising out of or relating to these Terms or the Services, the parties agree to make reasonable efforts to resolve the dispute through good-faith discussions before commencing formal legal proceedings.

If the dispute cannot be resolved amicably, it shall be submitted to the court or other competent authority having jurisdiction under applicable law.
